Terms of Service

These Terms of Service ("Terms") govern your use of the website, account system and checkout at iambeep.com (the "Site") and the products offered through it, currently including PolyShield, bvpn and Truth Seeker (the "Products"). They are offered by Hendrix Cole Odham ("we," "us") [[OWNER: replace with your LLC's exact legal name and mailing address once formed — the liability protection of an LLC only applies to contracts made in the LLC's name]].

By creating an account or buying a subscription you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Site.

1. Who can use the Site

You must be at least 18 years old (and able to form a binding contract) to create an account or buy anything. By creating an account you confirm that you are. If we learn that someone under 18 has an account, we may close it. [[ATTORNEY: confirm 18 is the right threshold for your products and states.]]

2. Your account

  • Give us accurate information, and keep your sign-in methods secure. We recommend a passkey or an authenticator app in addition to a strong password.
  • You must confirm your email address before you can sign in with a password.
  • You are responsible for activity under your account. Tell us promptly at the address below if you suspect someone else is using it.
  • Don't share your account or license keys with people outside your own organization, except where a Product's own terms say you may.

3. Subscriptions, prices and billing

  • Subscriptions are billed in advance, every month unless the checkout page says otherwise, through our payment processor Stripe. Prices are in US dollars.
  • The plan, every add-on, and the total you will be charged each period are shown at checkout before you pay. We add nothing that was not shown.   • Your subscription renews automatically each period until you cancel. Add-ons can be added or removed at any time; the change applies from that point on and is not credited or charged retroactively for the current period.
  • If we change a price, the new price applies from your next renewal, and we will give you advance notice by email [[OWNER: choose the notice period, e.g. 30 days]]. You can cancel before then.

4. Canceling and refunds

  • Cancel online, any time, from your Dashboard — it takes the same few clicks as subscribing. You keep access until the end of the period you already paid for, and you won't be billed again.
  • Our Refund Policy explains when payments are and are not refunded, including the statutory rights some buyers have that these Terms cannot take away.
  • If a payment is disputed (a chargeback) or a charge is refunded through Stripe, access to the related Product is suspended until it is resolved. This is an anti-fraud measure; contact us to sort it out.

5. Acceptable use

You agree not to:

  • use the Site or Products for anything unlawful;
  • use any Product to hide malware, ransomware or other malicious code, or to help it evade detection, or to infringe someone else's rights;
  • bypass, disable or tamper with billing, licensing, quota or device limits;
  • interfere with or disrupt the Site or our infrastructure, probe it for weaknesses without permission, or try to access any account but your own;
  • upload anything illegal or that you have no right to use.

We may suspend or end your access if you break this section, without a refund where the law allows.

6. Product-specific terms

  • PolyShield is downloadable software and is also governed by its End User License Agreement, which controls anything about using the software itself.
  • Other Products may have their own terms, shown where you sign up for them.

7. Intellectual property

The Site and the Products (excluding your own content and data) belong to us or our licensors. Nothing in these Terms transfers ownership to you beyond the rights expressly granted here or in a Product's own terms. You keep ownership of your own content and data.

8. Ending your account

You can delete your account yourself at any time from your account page; doing so cancels your subscription and removes your personal data as described in the Privacy Policy. We may suspend or end an account for breach of these Terms, non-payment, or fraudulent or abusive activity.

9. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE EXTENT THE LAW ALLOWS. WE DO NOT PROMISE UNINTERRUPTED OR ERROR-FREE OPERATION.

10. Limit of liability

TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, AND OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability for fraud, or for death or personal injury caused by negligence. If a limit above isn't enforceable where you live, it applies only as far as the law there permits and the rest still stands. 11. Your local consumer rights

If you are a consumer, you keep any mandatory rights you have under the law of the country where you live; nothing in these Terms removes them. If you live in the EU or UK, the Refund Policy explains your 14-day right of withdrawal and when you may give it up.

12. Export and sanctions

You may not use or download the Products if you are located in, or ordinarily resident in, a country or region subject to comprehensive US sanctions, or if you are on a US government restricted-party list. You will use the Products only in compliance with applicable export and sanctions laws.

13. Governing law and where disputes are heard

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in [[OWNER: venue county, e.g. ______ County, Pennsylvania]], except that this does not take away any right you have to bring a claim in your home courts under mandatory local law.

14. Changes to these Terms

We may update these Terms. We will change the "Last updated" date, and tell account holders by email about material changes. If you keep using the Site after a change takes effect you accept the new Terms; if you don't, you can cancel and delete your account. When the version changes we will also ask you to confirm again before your next purchase.
